Since Musk announced the campaign last month, America PAC has been awarding $1 million each day to selected individuals from crucial swing states like Pennsylvania, Michigan, and Arizona. The campaign initially appeared to be a random lottery-style giveaway, leading many to believe that anyone who signed a petition supporting the First and Second Amendments would be entered for a chance to win the cash. However, recent statements from Musk’s legal team revealed a different selection process, raising questions about transparency and legality.

During a court hearing on Monday, Chris Gober, a lawyer representing America PAC, disclosed that the recipients are not chosen at random. Instead, winners are pre-selected based on criteria set by the group. Gober stated, “The $1 million recipients are not chosen by chance,” emphasizing that the PAC has complete knowledge of who will receive the daily awards. As of Monday, the PAC awarded a voter in Arizona, identified only as Joshua, with the $1 million sum. America PAC also announced that the final recipient, who will be awarded on Election Day, has already been chosen from Michigan.

This revelation has drawn criticism, particularly from District Attorney Krasner, who argued that the public was led to believe it was a randomized selection process, akin to a traditional lottery. Krasner’s office, along with the U.S. Department of Justice, has scrutinized the giveaway since its inception, questioning whether the program violates federal election laws that prohibit incentivizing voter registration or voter support.

DA Krasner Labels Program as an “Illegal Lottery”

Philadelphia DA Krasner has been vocal in his opposition to America PAC’s giveaway. His lawsuit claims the program operates as an “illegal lottery” under Pennsylvania law.
