Modified Comparative Negligence:

Modified comparative negligence is further divided into two types: “50% Bar Rule” and “51% Bar Rule.” In states following the 50% Bar Rule, injured parties cannot seek compensation if they are determined to be more than 50% responsible for causing the accident. On the other hand, under the 51% Bar Rule followed by some states (including XYZ), an injured party can still pursue compensation as long as their level of fault does not exceed 50%. However, any damages awarded to them would be reduced in proportion to their contribution to the accident.
